Recent Supreme Court rulings are poised to significantly affect healthcare. In Loper Bright Enterprises v. Raimondo, the court overturned the Chevron doctrine, ending decades of deference to experts from federal agencies like the FDA and CMS. This shift could delay regulatory decisions on drug approvals, Medicare pricing, and nursing home oversight, and possibly overturn long-established federal rules.
In Moyle v. United States and Idaho v. United States, the court ruled that Idaho hospitals must continue providing emergency abortions under EMTALA if the mother's life is at risk, but it stopped short of broader rulings on abortion rights. Similarly, in FDA v. the Alliance for Hippocratic Medicine, the court preserved access to the abortion pill mifepristone (Mifeprex), but did so by sidestepping the issue. (The court decided that the doctors who brought the case didn't actually have the right to do so because they lacked "standing.") Legal experts have warned that these decisions were not true wins for reproductive rights; rather, they were short-term punts on technical grounds.
